AI Does Not Invent Music from Scratch: Legal Risks and Copyright Issues

The incorporation of artificial intelligence into music creation has opened new creative opportunities, but it has also generated significant legal challenges for producers and programmers at radio stations and television channels.


It is important to note that AI does not create music out of nothing. The models are trained on existing songs, scores, recordings, and music libraries, learning patterns of melody, harmony, rhythm, and style. When they generate a new composition, they combine and extrapolate these patterns, producing music that sounds original but is based on pre-existing works. For this reason, some AI-generated songs may resemble copyrighted material too closely, creating high legal risks.


Recently, Sony Music, Universal Music Group, and Warner Music Group filed lawsuits against AI platforms such as Suno and Udio, accusing them of using copyrighted music without authorization to train their algorithms. The lawsuits seek damages of up to $150,000 per infringement, highlighting the scale of the legal conflict.

Legal experts point out that it is important to:

• Determine the intellectual property rights of the musical tracks to be used.

• Avoid copyright infringement of existing works.

• Comply with synchronization and performance licenses in audiovisual media.

• Consult with legal experts before broadcasting programs, promos, or any content that includes music generated by artificial intelligence.
